These Terms of Service govern your access to and commercial use of the TankWatch Environmental Intelligence platform, data exports, subscription data licenses, and automated compliance digest services.

1. Platform Description & Scope of Services
TankWatch ("the Service", "we", "our", or "us") provides a specialized business intelligence SaaS platform designed for petroleum remediation contractors, environmental consulting engineers, and compliance professionals. The platform aggregates, resolves, geocodes, and monitors public records regarding Underground Storage Tank (UST) facilities, statutory compliance red tags issued by the Texas Commission on Environmental Quality (TCEQ), Texas Secretary of State corporate filings, and Texas Comptroller franchise tax data.
Subscription plans are billed in advance on a recurring monthly or annual basis:
Regional Consultant Pro (Monthly): $499.00 USD per month ($4,800/year billed annually). Geared toward environmental engineers, Phase I ESAs, and compliance consultants. Includes source-linked public-record research and dated exports for the selected service area.
Regional Contractor Pro (Monthly): $699.00 USD per month ($6,900/year billed annually). Designed for UST installation, removal, and retrofit contractors. Includes source-linked public-record research, filters, and dated exports for the selected service area.
Statewide Enterprise License: $1,499.00 USD per month ($14,400/year billed annually). Provides statewide access to source-linked public-record research, filters, and CSV exports. Availability and freshness depend on the underlying public sources.
All payment transactions are encrypted and processed by Stripe, Inc. We do not store or process raw payment card numbers on our infrastructure. By subscribing, you authorize automatic recurring charges to your designated payment method until formal cancellation.
TankWatch delivers source-linked public-record intelligence for research and review across Texas fueling infrastructure:
Regional Corridor Access: Subscriptions provide the applicable service-area dataset, filters, and source-dated facility dossiers. TankWatch does not provide exclusive territory, lead ownership, direct decision-maker contacts, regulatory conclusions, or real-time emergency alerts.
Permitted Commercial Use: Intelligence provided by TankWatch is licensed solely for internal business development, engineering assessment, remediation bidding, and risk underwriting. Reselling or distributing raw dataset exports to third parties is strictly prohibited.
Account Integrity & Security: Subscription licenses and API tokens are licensed exclusively to the subscribing enterprise entity. Account sharing across unaffiliated organizations or unauthorized automated scraping will result in immediate termination of access without refund.
4. Cancellation, Changes & Refund Policy
Subscribers may cancel their subscription at any time through the self-serve Stripe Customer Billing Portal accessible via the TankWatch navigation bar.
Effective Date of Cancellation: Cancellation halts future recurring billings. Your account retains full access to licensed territories through the conclusion of the current prepaid billing period.
Refund Terms: Because TankWatch provisions immediate access to source-linked public-record research and downloadable CSV data upon payment, subscription fees are non-refundable once billed, except where required by applicable law or in the case of a verified technical service failure exceeding 72 consecutive hours.
5. Public Records, Environmental Disclaimer & Non-Warranty

TankWatch synthesizes public records under Texas Public Information Act statutes, including Texas 30 TAC § 334 and EPA 40 CFR Part 280. TankWatch is not a state agency, not affiliated with the TCEQ or EPA, and does not provide formal legal counsel or professional engineering site certifications.
Tank age calculations, hydrogeological proximity scores, and compliance tag notifications reflect data published by state and county sources. Contractors and engineers must independently inspect all physical facilities, verify tank configurations, and review official state filings before submitting commercial bids or executing construction contracts.
6. Limitation of Liability
Under no circumstances shall TankWatch, its officers, directors, or employees be held liable for any indirect, incidental, punitive, consequential, or environmental contamination damages arising out of your reliance on platform intelligence, missed inspection deadlines, or failure to close prospective remediation contracts. Our total aggregate liability for all claims related to the Service is strictly capped at the total subscription fees paid by you to TankWatch in the twelve (12) months preceding the claim.
7. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the state or federal courts located in Travis County, Austin, Texas.
